I found this out when I tried to go back to work so I guess I will share it with all fo you so just in case it wont happen to you. Your employer does not have to hire you back if you have not worked there over a year and logged in over 2200 hours. Also your employer has to have 50 emplyees within a 75 mile radius. That means if there is another store from the same company within 75 miles the amount of employees there and at your store has to make 50. If the FMLA doesnt cover you because of the above and your employer tells you verbally that they will hire you back (mine did then he didnt) make sure you get it in writing. Hold them to it. My boss told me I would be hired back then he doesnt do it! He had to hire three people to replace me- it would make me think he woudl want me back so he would save money.
