Family And Medical Leave Act Question

I've looked on the website and can't find any info on if this applies to non profit organizations. I work for a non profit and was not sure if the family and medical leave act will help me? What do people do if their employer does not offer matern. leave? We have a small staff of 6... Just wondering.

If you staff is only 6, then FMLA is not required to be offered through your employer. Only employers that have over 50 workers have to have FMLA available.

You can also check with your state and see if they offer short term disability. Each state is different and many do not. You may be able to work something out with your boss though.

The FMLA applies to any employer with 50 or more employees in a 75 mile radius. It doesn't matter if you are non-profit or not, just your size. Even if you don't qualify, your boss may agree to give you maternity leave if he/she wants you to return. The FMLA does not pay -- it just provides job protection. If you live in California, you can get 6 weeks of paid leave (Paid Family Leave) if you pay into SDI. For paid leave, your employer's size does not matter but there is no job protection.
