I worked as an independent contractor from Jan 2009-Dec 2009, and then joined the same company as a full time employee in Dec 2009. I am due in August 2010. I definitely meet the hours worked requirement, but I am short on the 12-months of employee status. I am wondering, however, that since I was on the company's payroll and performed similar functions as a contractor vs. employee, if I am eligible for FMLA? Please advise!
