I am wanting to switch jobs in the summer of 2008 and want to also have a baby in the winter of 2008. I won't qualify for FMLA because I will not have been with the company for a year. Does anyone know if I can be let if I take 12 weeks of maternity leave but it is not covered ny FMLA?

Yes you can be let go. If you do not qualify for FMLA then legally they do not have to hold your job for you. Sorry!

The company has no legal obligation to hold your job. But some companies have different policies. You'd have to talk with human rescources to know for sure.

BTW, if you're not pregnant yet, i wouldn't worry about it. You never know what might happen in that department, it could take longer than you hope to get pregnant and then this would not be an issue for you.
