Short Term Disability Question

Hi all - I am on leave (my company dosn't want to call it maternity leave since I am in Japan and they said I don't qualify for FMLA). I have taken a "leave without pay" and filed for short term disability while on leave but I am strongly thinking of not going back once my time is up. If I am approved for the short term dis and then quit at the end, would I have to pay that back? I don't really want to ask our HR department as they have given me nothing but a hard time since being preg with the whole FMLA thing....

It depends on the company and what all doc_ments you signed. In our company we require all STD applicants sign a pay back agreement stating they must stay with the company at least 6 months after coming back or they must pay it back.

I agree with Kelly, that it depends on what you signed. But most companies don't make you pay it back. Again, you'll have to check with your HR department. You should have been given a copy of the policy and copies of what you signed. So, that's where you'll need to start.

I have my own short term disabilty through work but once I started it goes with me if I leave the job. It's my policy (individual) I don't have to pay it back because I pay premiums. THe group plan I'm on I think may be different but now that they have terminated me because they couldn't comply with the doctors restrictions, I still get the disability because it was approved before they got rid of me. but the good thing I don't have to pay that back!!! I couldn't be on FMLA either because I wasn't there long enough, so I have no defense... until I call the Women's Bureau at the US Dept. of Labor.... Then we'll see what happens! Good luck I'm sure you get the disability, and if they give you a hard time there is a Pregnancy Discrimination Law.
