NEED ADVICE ASAP

I recently recevied a summons on my door stateing that my son's paternity is the the subject of controversy and my son's father is requesting genectic blood grouping tests to determine paternity.I don't know how its a controversy when he is the father of my child.My son is 6 months and he has only seen the child once. I have contacted my son's father many times asking him to support his son but he stated he will when he knows the child is 100 percent his. I had set up a paternity test to be done back in October but he would not pay for it...He thinks by going through the court he does not have to pay for this test to be done..Are paternity tests through the courts free?? Do I need to hire a lawyer for this situation??

I believe it differs by the state you live in. Typically, the man is required to pay for it. I would do a search on paternity testing laws in your state. Good luck, he WILL pay!

There must be a phone number on the summons you can call. Get it done ASAP so you don't have to deal with it anymore. In any case you have no legal right to financial child support if paternity is in question, so once that is established you can both move on. Good luck!

I understand what u are saying, but he knows that he is this childs father. I just don't understand how he going to take me to court for a paternity test, when back in October I set up an appointment to have a test done and he would not do it nor would he pay for it after he said he would pay for the test to be done. I have tried talking to his mother and all she could tell me was her son told her to stay out of this til he finds out weather the child is his. He has told his mother so many things about me that are not true, she bacically didn't want to hear nothing I had to say. She also said if the child is his my son's last name will be changed. Can this be done in the state of Virginia? Also I wanted to know will the court grant the father unsupervised visitation when he has a criminal record? The reason I ask is because when I was four months pregnant I payed to have a background check done on my childs father and he had been charged with something very serious, but when I confronted him about it, he said that the charge was reduced to something else and who gave me permission to do a background check on him. I'm really stressing about this situation I just don't know what to do:(

How well did you know your baby's father??? I mean if you are having back ground checks after getting pregnant I can imagine you didn't know him at all....You should really get a lawyer and not rely on some random responses here. It is worth the several 100 dollars to get legal advice about paternity and visitation. I would a__sume he has definately a legal right for unsupervised visits, unless he was found guilty of a violent felony--meaning not forging checks or something of the likes--....What did he do that was so bad as to want all his visits supervised?

I actually knew him in high school, but after high school he moved to GA.Then out of the blue he contacts my brother on myspace asking about me. My brother gave him my email to contact me.We talked for a couple of months and then he moved to Virginia to get a job making more money.Everything was good between us until I told him I was pregnant. He wanted me to get abortion which Iwas not going to do. He even went as far as to tell he would make me get an abortion.But to make a long story short after I told him I was pregnant everything went down hill after that. Basically everything this man told me was a lie.He said he owned his own house, that was lie. he said he was single when he was in GA,that was lie.He even told me he was offered a job making six figures, I found out that was a lie as well. The reason why I want my childs visits supervised is because he was charged with Enticing a child for s_xual favors.After I found this out I told him I didn't want to see him anymore.

Based on you stating that he has a record for a s_x crime against a child, I highly doubt he will be allowed unsupervised visits with your child. As the other poster said, you should contact an attorney. If payment is an issue, contact your local health department who can provide you with a referral for free or very affordable legal advice in your area. Good luck.
