Im 18 and 4 months pregnant, my ex boyfriend is the one im POSITIVE is the dad but he's denying it to everyone. If i put his name on the BC he's the legal father until he can prove otherwise right? This is what i need help with.. if anyone knows please let me know! He's saying that I have to pay for the paternity test and prove he's the dad before i can do or collect any money and my doctor tells me if i put his name down HE'S gotta prove he's not the father. soooo im confused!!

I believe it depends on the state you're living in, but if you place his name on the BC, he IS considered both the biological father and financial provider. He is recognized on all levels of paternity. If he chooses to counter that accusation, he will need to do a paternity test. If he denies paternity, he is the one that must pay for the test. Technically yes, he must be considered the father in order to collect child support. But if he is on the BC, you can take him to court for the support. Like I said, if he counters that, then they'll do a paternity test. But until he does, he is considered the father. im not sure how it is where your from but in order to put someones name on the BC if they are not your husband they have to be there and sign something stating that they are the father. OTher wise hell you could but brad pit down as the father. So in fact i thing it will end up being you who has to prove that he is the father. If your getting any state aid at all they generaly will cover a paternity test.

Well I live in Florida and here the father has to be present to sign papers with his drivers license in order to be put on the birth certificate. If he is present and does this and you try to collect child support he would have to pay for the paternity test if he still requests one, they would court order because he basically admitted paternity by signing those papers at the hospital. Now if he doesnt sign the papers and is not on the birth certificate you file for child support the same way and then they will send him something asking him if he agrees to paternity and if he doesnt they will court order a paternity test and he will have to pay for it if hes the father but if hes not the father then the mother has to reimburse the state for it. Hope this helps and I am sorry you are going through this. They can go from someone you love to someone who causes you so much misery and pain quick.....

You should be careful about putting his name on the birth certificate until you are sure you want him in your baby's life. If his name is on the b/c he has all the rights you do and can take the baby from you unless you have court ordered visitation already arranged. Without court ordered visitation there is nothing legally stopping him from just not bringing your baby home one day (I know for a fact this is true in the states of Texas and NC)

Just because his name is on the birth certificate or record does not automatically ent_tle him to joint custody. It depends on the state. I would look up the law in your state or call the state and someone will help you. Some states only allow you to list the father on the birth record, but not the birth certificate unless he signs it. This is because it's not fair for you to just name a father and that man may not even be the father. So he must either agree he is or take a test to prove he is or isn't. Some states make you split the cost of the testing. Only information from your state will help you because the law varies.

I live in PA, and in this state, the father has to sign a paternity form in order to be considered the biological father. If he refuses to sign this form, then you just go to domestic relations, sign up for child support ,and tell them who the father is. Then they will court-order a paternity test (which is free for you) and he is required by law to take it. Then when the results come back and show that he's the father then they will hold a support conference to determine how much he will pay in. It really has nothing to do with the birth certificate.
