I've been trying to get into this firm the last few months. However, due to internal issues, it didnt happen then. I've already passed the reference and background checks a few months back when I originally met the main hr director(now on maternity leave). A new position is open due to an internal promotion. I went and interviewed with this team, see if it's a good fit. The hr assistant told me things went very well. She told me their office manager would be calling me to talk to me about it.
My BIG concern is this: I am 5 months along now. I am showing somewhat but not real obvious yet. For over a year, I've been struggling to break into this field(legal) & start my career. I've dealt with worthless employers already and this field is very compet_tive, even entry level! I've been giving my heart & soul to do this and this can be the break I finally need! I really want this job and to join this firm but I dont want my pregnancy to screw it up. I know it is illegal to discriminate for this but I have already experienced "sorry" 2 times so far upon receiving job offers when I told them. It is costing me jobs and financial heartache being unemployed.
This firm only has a 30 day waiting period before all of your benefits kick in and may I add very good ones. The main hr lady wont be back from her maternity leave until 2 weeks after when I would start, so it would be a good time to approach them on this(or wait the 30 days?). I am bored sitting at home, need the 2nd income to stay a float and for baby things, and EAGER to start my career in a good place but this an issue for me.
I feel if I drop the bomb now before I start, I am screwed(I've learned from different offers a few months back..SORRY!)! I'd rather start than tell them so they cant fire me for it or say SORRY. Also, how should I present this to them? I am due around Christmas and most firms usually have some time off and work is slow(may benefit me) but I want them to be able to have a plan in place of how my job will be covered until I returned and enough time to plan this.

Well, I'm about 6 months along, and job searching myself. (My story on that is on the general pregnancy board, job searching while 6 months pregnant thread.) I would definitely wait to say until the job is officially offered, or even as you say, actually start working. I'd go ahead and mention it when the hr lady comes back. Tell them you plan to continue working after the baby comes. They can't fire you, but they don't have to hold the position while you're on leave, as you won't be covered by the FMLA. Good luck, let us know how it goes.

wouldn't the pregnancy discrimination act cover our job? I read on it last night and it states they have to hold our job like anybody else on a leave, etc. Or is that if you qualify for fmla?

Your job is only covered if you qualify for FMLA (Family & Medical Leave Act). You have to be full time at a job for 12 months before you qualify. If you don't qualify, then when you take time off they don't have to cover your position while you're gone. They can fill your position and not break the law. That's not to say they WON'T let you come back, but they just aren't legally bound to. The pregnancy discrimination act says that you can't be fired or turned down for a job because of pregnancy (but illegal or not it happens. I know, it's been happening to me.)
