Confused Whats Your Conclusion Would You Sue A Hospital

I'm so confused about my situation i dont know where to start. When i was 14 i was rushed in to emergency operation as i was internally bleeding from an ovarian cyst. They did key hole surgery through my belly button but then had to make an incision like a c-section and From what i rememebr being told after wards they were able to save my right ovary (the one the ruptured cyst was in). Well i am now 22 weeks pregnant and when i went to for a cheek up at my local hospital when i was 19 weeks pregnant they were going through my medical history. They mentiond the operation i had at 14 then they were talking about my sons birth (he was born via c-section). I seen it in black and white, the surgen noted that i DID NOT have my right ovary. When i was told this i was shocked!! I told the doctor that the doctor who did the surgery when i was 14 said i still they saved that ovary. Well anyway they are now trying to get my medical records from that operation when i was 14 as the doctor is soo sure that i do not have that ovary as when you have a c-section they "check" to see if everything is still there after a c-setion before they st_tch you up, i cant see how they could be wrong after all they they would see it plane as day while you are still open. Now the confusing part. Between the operation when i was 14 and having my son i have had number of ultrasounds which shows a right ovary with so many follicals but before after having my son and before "this" pregnancy i had not had 1 ultrasound done so i dont know. The other day i was in hospital due to pain and they did a scan which in their eyes confirmed i do not have that right ovary. The only conclusion i can come up with (as i have "profe" i had the right ovary before i had my son) is that they cut the right ovary off when they were doing the c-section. As i said, the hospital is trying to get my medical records from the operation when i was 14 but like i said to DH, they are not going to tell me they saved the right ovary during that operation when i was 14 then all of a sudden at my c-section its gone, i mean they will be cutting there own throats, So i am going to get my hands on the medical records myself. If what i am saying is right, i am going to sue the ars of this hospital, i never thought i would be in a situation like this. Any advise? What does it sound like to yous, same conclusion i came up with?

LOL sorry about the typos, i was rushing. I was ment to say, AFTER having my son and before this pregnancy i had not had 1 ultrasound done.

Man, are you saying they could have cut your ovary off during the c-section ?? Oh yah, i would be suing them as well.

If they did cut off the right overy at the time of the c-section, I would sue too, but it seems more likely you misunderstood the doctor after your surgery at 14….

Thats the only thing i can that i can think of that has happend. I will be demanding more scans after i have this baby.

I cant off misunderstood though, i have ultrasounds sitting in my room after that surgery and before having my son "showing" a right ovary with follicals.

It happened so long ago, I doubt you could do anything. Plus, you have to prove damages. If you are pregnant, then what damages do you have? You are still able to have children right? It is really hard to sue for malpractice these days. Check out your options and see what is a possibility in your case.

DeeD, i only had my son two years ago. The damage if they did cut my right ovary off? They have taken half of the thing away that defines me as a women. And yes i am pregnant now, but why not cut off my toe still will beable to walk right?

Let me get this straight. You think you lost your right ovary during a c-section when your first son was born? Interesting. It would be hard for a dr to accidentally cut off an ovary and remove it from the body. The ovaries are connected to the body by ligaments and to the uterus by the fallopian tubes. Its not unheard of after abdominal surgery for the ovary to not be in the "exact" spot it was prior. Its even possible for them to "move" away from the u/s. Its quite possible your technician didn't find the ovary during your u/s or have a blood drawn. Regarding your lawsuit, you'll have to demonstrate that the loss of your ovary caused irrevocable damage. Since you are pregnant right now, that may be hard to do. You'll need a good lawyer for this one.

Sorry - incomplete thought. That should have been: "Its quite possible your technician didn't find the ovary during your u/s. I'm surprised your doctor didn't have a blood drawn to verify."

I wasn't trying to be rude Kristie. I had serious damage done to my spine during a wacko epidural. He stabbed me over 30 times trying to get it in. It took him 3 hours. I still to this day have pain and have a scar line 4 inches long. I went to several attourneys...all of them said I had a case...noe of them would take it becasue it wasn't worth enough. My damages weren't enough. I imagine, since you can still have kids, you would probably be in a similar position. I could still walk, run, exercize etc. They didn't care that I was in pain. So, there wasn't enough damages to make it worth it to them. I don't disagree with you. If your ovary was cut off, geez...that is a big deal. But I don't know if an attourney would think there was enough money involved to take the case since you can still have kids. I would get on the ball right away with an attourney to see what and if you can do anything. In Arizona you only have two years, so you would be almost out of time to even file any ways. I was in no way trying to diminish what may have been done to you. Hope this helps! GL!

DeeD its ok. After seeing what you ladies think i am so p__sed off how surgens and doctors can get away with things like this, Just because you can walk run etc and in my case still have kids. I will talk to a lawyer and see if they think it is worth it, the scary thing is, i am booked into the same hospital i had my son at to have this one.

Kristie - I had similiar situation as DeeD. I fractured my vertebrae and punctured my stomach during my 2nd year of vet school. The hospital misdiagnosed me and sent me home. I later developed a septic condition and nearly died. Because I recovered from my injuries, and even though I had to quit vet school, every lawyer I talked to said I had no case against the hospital. I tend to think that either your ovary was removed during your first surgery, or that its simply hiding right now. I've done hundreds of c-sections and hysterectomies, it would be very hard for a surgeon to remove an ovary and not know it.

Kristie h - what state do you live in? The same thing happened to me - two ovaries before my first c-section, only one found during second c-section.

Have you spoken with a lawyer? What ended up happening? Did you sue?
